Terms and Conditions of Sale.

1. These terms apply to Consumer orders. Individuals acting on behalf of businesses must ensure they have authority to act on behalf of the company.

2. Definitions
a. "consumer" means an individual acting for purposes which are wholly or mainly outside that individual's trade, business, craft or profession.
b. "trader" means a person acting for purposes relating to that person's trade, business, craft or profession, whether acting personally or through another person acting in the trader's name or on the trader's behalf.
c. "distance contract" means a contract concluded between a trader and a consumer under an organised distance sales or service-provision scheme without the simultaneous physical presence of the trader and the consumer, with the exclusive use of one or more means of distance communication up to and including the time at which the contract is concluded.

3. Statutory Information

b. Goods and Services requested to be provided to the consumer will be confirmed in writing via email to the email address provided by the consumer during the checkout process.
c. If there are any additional charges that could not be quantified in advance of the checkout process, the consumer will not be contractually obliged until the additional charges have been agreed with the consumer. Typically this is restricted to shipping costs for heavy or bulky items to overseas (non-UK) addresses but the website will normally indicate if products are not available to overseas consumers.
d. Payment will be made by the consumer in full at the end of the checkout process. We are under no obligation to the consumer until payment has been made in full.
e. We will usually dispatch within one working day but unless agreed in advance time is not of the essence for us to deliver the goods or services however we will notify the consumer if delivery is likely to be in excess of 14 days and provide an estimated delivery date.

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

The Consumer Protection from Unfair Trading Regulations 2008
The Consumer Contracts ( Information, Cancellation and Additional Charges ) Regulations 2013

4. Cancellation
a. If we are unable to deliver all or part of an order and no suitable alternative can be agreed with the consumer we will refund the affected portion of the order without undue delay and the affected portion of the order will be deemed as cancelled.
b. Consumers may cancel their order within 14 days of receipt of the goods or anytime prior to dispatch provided that goods are not perishable, custom made, subject to hygiene restrictions, or unsealed publications such as books, audio/video recordings and software. Consumers cannot cancel their order if the goods have been used or irrevocably changed (by mixing constituent parts for example.)
c. Consumers are responsible for the return of cancelled goods at their own expense.
d. Consumers must notify us in writing to cancel an order, a form is available online for this purpose at http://www.walkhigh.co.uk/acatalog/Returns.html
e. Refunds will be made to the consumer via their original payment method within 14 days after the day the goods have been received back. The amount will include the cost of "basic" or the least expensive delivery cost, irrespective of the actual delivery type chosen by the consumer.

5. Delivery
a. If the goods supplied by us do not match our description and a change of specification had not been previously agreed the consumer is under no obligation to accept the goods. The consumer must let us know about any such discrepancy as soon as is reasonably practical and we will pay for the return or collection and refund or replace the goods as appropriate.
b. If the goods supplied by us become faulty within their warranty period or reasonable lifetime, consumers should first contact us for advice. We aim to only supply high quality goods and where appropriate will expedite repair or replacement on behalf of the consumer.
c. We reserve the right to refuse to deliver to an address and in such circumstances will request an alternate address, usually this will be the card holders registered address.

6. Other
a. CURRENCY: we charge in GB Pounds Sterling only. Prices shown in Euros are approximate and should not be relied upon.
b. VAT: EU consumers are obliged to pay UK VAT on most items. Non EU consumers will have the VAT removed automatically at the checkout.
c. UK ARMED FORCES: UK Forces stationed overseas can use 'BFPO Overseas' as their destination country to obtain VAT free invoicing. The consumer must provide us with an application for exemption from VAT under Article 15.10 of the Sixth VAT Directive or, if not available, a written order/certificate confirming eligibility under that Article PRIOR to dispatch.
d. DISCOUNTS: Discounts are offered to certain groups, proof of membership must be provided and not all products qualify for a discount. Excluded items include but are not limited to: shipping, sale / special order / special offer / already discounted items, products from Versaclimber, Magellan, Montane, Polar , also Books, Videos and Ropes.
e. COMPLAINTS: We take all complaints very seriously, consumers should contact us with their order number and the nature of the compaint. We will investigate and attempt to resolve the issue as quickly as possible but if a mutually acceptable solution cannot be agreed we or the consumer can opt to refer the case for Online Dispute Resolution at http://ec.europa.eu/odr

7. Force Majure: We shall not be liable for any failure or delay in performance of our contract, if it is due to an event beyond our reasonable control. Including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed we shall be entitled to a reasonable extension of time for performing such obligations.


Privacy Policy.

You can browse our site(s) without disclosing any personal data to us. Any links to third party web sites are covered by the third parties privacy policies.

We do not automatically log personal data nor do we link information automatically logged by other means with personal data about specific individuals.

Cookies are placed / collected to monitor visits but not used to store personal data.

We will collect and store information about you to allow us to firstly, process and fulfil any order requirements and secondly to provide you with the best possible service. We will collect and store any personal data that you may volunteer whilst using our services. All information is collected lawfully and in accordance with the Data Protection Act 1998.

We may use the data for our own marketing purposes, including market research and to keep you up to date with any offers or information regarding our stores or direct sales channels.

The type of information that we will collect will include,

Individuals registering their details or subscribing to any online service we currently offer or offer in the future do so on the understanding that they are aware of the intended purpose for the collection of data. They will be sent further information / communication via email only.

Information about you will not be shared or transferred to any other companies without your consent.

We will strive to always hold accurate and up to date information about you. You can gain access to information that we may hold about you by writing to us.

We will provide you with a readable copy of any personal data that we may hold about you, within thirty days of receipt of your request.

We will provide the information at a charge of £10.00 payable with your request.

You should also enclose a self addressed and stamped envelope and proof of your identity before we will release any data.

In instances where you find information that we hold about you to be inaccurate we will correct or delete it promptly.

We reserve the right to refuse to provide a copy of any personal data held, but will give reasons for our refusal.
